In this short study programme, participants will study the basic notions of commercial law, namely the definition of ‘trade’ and ‘traders’, and other ancillary notions which apply. Participants will also focus on different forms of trade and traders which exist, along with the notion of capacity to trade.

Participants will be guided through the sources of commercial law, namely the law (commercial or civil) and usages of trade developed along the year.  A focus on partnership formation and operation will also provide participants with the opportunity to understand how traders conduct their business in practice.

Who should attend?

Anyone interested to understand Commercial Law, In-house lawyers, lawyers working in private practice, law students.

2 Advanced level subjects at Grade C or better, and 3 Intermediate level subjects at Grade C or better. 1 of any of these subjects must be Maltese or English

OR

3 Advanced level subjects at Grade C or better

OR

Mature/Adult Learning Student (must be 23 when course starts) subject to an interview by the Head of the Academy.

There will be;

one assignment and students will have a choice – they will be able to choose 1 assignment out of 3.

AND

Multiple Choice Exam.

By the end of the study programe the participants will understand:

  • The basic principles of commercial law;
  • The historical development of Maltese commercial law and its relationship to UK commercial law;
  • The differences between the application of commercial law, custom and usages of trade, or regular civil law;
  • Who a trader is and when one can be considered to be so;
  • Barriers for traders to trade;
  • Emancipation of minors to trade;
  • What classifies an act to be an act of trade in its objective and subjective sense;
  • The traditional forms of doing business via limited and unlimited liability partnerships and business models.
Accreditations
The Malta Further and Higher Education Authority deems this Award to be at Level 5 in the Malta Qualifications Framework and the European Qualifications Framework for lifelong learning.
