Through this course, participants will be introduced to the principles underlying national constitutions, commencing with an in-depth look at the basic principles of public and constitutional law in the modern nation state, covering the rule of law, human rights, and the formation of modern-day governments. Such principles will then be applied and studied in the context of the Maltese Constitution, while comparative studies with foreign constitutional documents will also be drawn.

Participants shall also briefly study the historical development of the Maltese constitution, from the earliest documents granting self-government, to the present-day Constitution making Malta an independent state, and consequently, a republic. Participants will also be encouraged to discuss ongoing consultations on constitutional reform and the implications thereof.

Who should attend?
Anyone interested in the Maltese Constitution, In-house lawyers, lawyers working in private practice, law students and supporting staff in law firms or legal offices.

2 Advanced level subjects at Grade C or better, and 3 Intermediate level subjects at Grade C or better. 1 of any of these subjects must be Maltese or English

Mature/Adult Learning Student (must be 23 when course starts) subject to an interview by the Head of the Academy.

There will be two assignments and students will have a choice – they will be able to choose 2 assignments out of 4.

  • A thorough understanding of public law principles and their practical application vis-a-vis constitutional law;
  • An understanding of the historical development of the Maltese Constitution and its transition over a period of 150 years;
  • The division of state powers and the authorise or persons appointed thereto;
  • A thorough understanding the local general electoral system and the way in which it works;
  • Knowledge on local and international fundamental human rights, together with a thorough coverage of related case-law.
Accreditations
The Malta Further and Higher Education Authority deems this Award to be at Level 5 in the Malta Qualifications Framework and the European Qualifications Framework for lifelong learning.
