Course Objectives

This short study unit is intended to introduced participants to the field of employment and industrial law, both in the private and public sector, among which the rules may occasionally differ.

Participants will have the opportunity to learn about various aspects of local employment law regarding the minimum established conditions of employment, the nature of definite and indefinite contracts, the terms of termination of employment and the defences related to it, among others. Due importance is also given to the role of trade unions and associations. Due importance will also be given to the workings of the Industrial Tribunal, together with reference to the relevance and importance of welfare legislation in terms of employment and industrial relations.

Who should attend?

Anyone interested to understand the Maltese employment law, practicing lawyers, in-house lawyers, law students, those working in human resources or managerial and supervisory positions..

2 Advanced level subjects at Grade C or better, and 3 Intermediate level subjects at Grade C or better. 1 of any of these subjects must be Maltese or English

3 Advanced level subjects at Grade C or better

OR

Mature/Adult Learning Student (must be 23 when course starts) subject to an interview by the Head of the Academy.

Participants must also complete 1 out of a choice of 2 assignment titles.

Participants will also sit for an oral examination.

At the end of the study programme the participants will be able to:

  1. Analyse and interpret provisions of employment laws, whether local, foreign or EU-based;
  2. Conduct research into the various different forms of employment law and comprehend the differences between them, and which would apply in any given case;
  3. Meticulously assess agreements and policies relating to employment and point out inconsistencies within them;
  4. Identify cases where a breach of law exists;
  5. Identify solutions and remedies to the above;
  6. Analyse jurisprudence relating to employment law (Industrial Tribunal and Court of Appeal).
  7. Interpret and understand the wide variety of existing employment law;
  8. Compare and contrast local law with foreign or international law relating to employment;
  9. Understand the manner in which any provisions or principles from foreign or EU law may be introduced or applied under Maltese law.
Accreditations
The Malta Further and Higher Education Authority deems this Award to be at Level 5 in the Malta Qualifications Framework and the European Qualifications Framework for lifelong learning.
